ESMA consults on AIFMD passport and third country AIFMs

The aim of this call for evidence is to gather input on the key issues that will determine the orientation of ESMA’s opinion.

ESMA opened a call for evidence on the Alternative Investment Fund Managers Directive (AIFMD).

ESMA has to develop an Opinion under the AIFMD on the functioning of the EU passport and of the marketing of non-EU AIFs by EU AIFMs in the EU, as well as on the management and/or marketing of AIFs by non-EU AIFMs in the EU.

Besides its Opinion, ESMA must also issue advice on whether the passporting regime should be extended to the management and/or marketing of AIFs by non-EU AIFMs, and to the marketing of non-EU AIFs by EU AIFMs. 

ESMA will consider all responses received by 8 January 2015.
