Council documents on draft Pension Portability Directive

The Council made public two documents on the draft Directive on improving the portability of supplementary pension rights including the latest revision of the text of the Directive. The progress report analyses the state of play and asks several questions to the Ministers.

On Transferability, the progress report asks Ministers if they can agree:

  • that the Directive should focus on vesting criteria as well as on the preservation of pension rights through a fair treatment of dormant rights?
  • that this Directive should not contain provisions for transferability?

    On Supplementary pension schemes the progress report asks Ministers if they agree, taking into account the combination of a long transitional period and the suggested exclusion of certain schemes, that the Presidency text would give sufficient time to supplementary pension schemes to adjust to the new rules?
